The aforementioned general terms of use (EULA or End-User License Agreement) aim to legally supervise the website provision’s and services’ modalities by MyCarRegister and to define both terms of access and services use by “the User”.

The aforementioned terms of use are available on the website “EULA” section.

Every website’s registrations and uses involve the unreserved and unrestricted approval of aforementioned EULA by users. During the website registration through the registration form, users explicitly accept said terms of use by ticking the box preceding the following text : “I acknowledge having read and understood the general terms of use, and accept them”. In case of terms of use non-approval, users have to give up their access to services offered by the website.

MyCarRegister reserves the right to modify the content of said terms of use unilaterally and at any time.

Article 2 : Website access

The website MyCarRegister offers the following services to premium users :

• Management of car registers : identification and follow-up of car histories
• Access to other users profiles (if they permitted access)
• Possibility to comment pages created by other users (if they permitted access)

The website MyCarRegister offers the following services to free users, within the limit of a one-month free trial :

The website is freely open from everywhere to every user having an Internet connection, apart from the private section requiring a subscription. All costs to access the service (hardware, software, internet connection, etc) are at the expense of users.

Non-member users can’t access to paid services nor free trial. They have to register by filling a form. Agreeing to register to restricted services, member users pledge to provide honest and correct information about them and especially their email address. In case of subscription to membership, users pledge to provide honestly their identity (Last Name, First Name) and their address.

To access services Users then have to login with their usernames and passwords.

All regularly logged in member Users will also be able to request their unsubscribing visiting the dedicated page on their personal space. It will be taken into account in a reasonable time.

All occasions due to cases of force majeure resulting in a website/server malfunction and subject to outage or changes in the event of maintenance don’t involve the responsibility of MyCarRegister. Users thus accept to not hold it against the editor in case of discontinuation or suspension of services even without prior notice.

Article 3 : Data collection

The website guarantees Users personal data are collected and processed in compliance with law n°78-17 (January, 6th 1978) relative to computing, data and freedom.

Article 4 : Intellectual property

Brands, logos, signs as well as all website elements (code, texts, pictures, sounds…) are protected by Intellectual property code and more specifically by copyright.

Users have to make a prior request to the website for any duplication, publication and copy of various contents. They pledge to use the website contents in a strictly private context, any commercial and advertising use being purely forbidden.

Any total or partial representation of this website by every possible method, without unambiguous website owner’s authorization would represent a counterfeiting punished by article L 335-2 and following of Intellectual property code.

You are reminded that users who duplicate, copy or publish a protected content have to quote the author and the source according to article L122-5 of Intellectual property code.

Information sources shared on website MyCarRegister are esteemed as liable but the website can’t guarantee there aren’t any flaws, mistakes or omissions.

Despite regular updates, website MyCarRegister can’t be held responsible for changes of administrative and legal clauses occurring after posting. Website also can’t be held responsible for the use and interpretation of information displayed across this website.

Users make sure they keep their passwords private. Any password disclosure is forbidden, regardless the method. They assume risks associated with the use of their usernames and passwords. Website declines all responsibility.

Website MyCarRegister can’t be held responsible for possible virus which might infect users computers or hardware due to the use, access or download from this website.

The website’s responsibility can’t be involved in case of force majeure or due to unpredictable and insurmountable event of a third party.

Article 6 : Hypertext links

Some hypertext links may be used on the website. Users have to know they will exit website MyCarRegister by clicking these links. MyCarRegister doesn’t have any control over the web pages users reach and can’t be responsible in any case of their content.

Article 7 : Cookies

Users are informed a cookie might automatically set up on their browser software during their website viewing sessions.

Cookies are small files temporarily stored on the users computer’s hard drive through their browser and are necessary to use MyCarRegister website. Cookies don’t contain any personal information and can’t be used to identify someone. A cookie contains a unique ID, randomly generated and hence anonymous. Some cookies expire at the end of users’ sessions and others remain.

The information held inside cookies are used to improve MyCarRegister website.

Users accept them by browsing the website.

Users will be able to disable these cookies via settings located within their browser software but the website may not properly work.

No monitoring audience or tracking cookies exist on the website.

Article 8 : Users publications

The website allows members to publish content pages (chassis, events, museums, spotting, shootings, references…).

Users pledge to respect rules of the Netiquette (rules of good behaviour over the internet), rules of applicable law and rules of website usage :

• Never publish private information about the cars’ owners : last name, first name, address and contact details (email, address, phone number, social media…).
• Never publish pictures taken in a private location without owners’ permission.

The website may moderate publications and reserves the right to deny their upload without any explanation to members.

Members remain owners of all their intellectual property rights. But publishing posts on the website implies the transfer to editing company of non-exclusive and free right to represent, copy, adapt, edit, broadcast and share publications directly or through an authorized third party, all over the world, on any medium (digital or material), for the intellectual property duration. Members specifically yield their right to share their posts over the internet and smartphone social media.

The editing company pledges to show users aliases close to all their shared posts.

All content posted online by users are their sole responsibility. Users pledge to not publish elements that may violate third parties interests. Every legal action initiated by a violated third party against the website will be supported by users.

Users' content can be deleted or modified by the website without notice, at any time and for any reason.

Article 9 : Applicable law and qualified jurisdiction

French legislation applies to the aforementioned contract. If a legal dispute between both parties can’t be addressed in a friendly way, French courts will be the only qualified entity to settle the dispute.
